When this applies
Common spousal & relationship transfers we handle
Whatever the reason ownership is changing between you and your partner, the transfer must be properly documented and registered before it takes legal effect. We take care of all of it.
Adding a partner to title
Bringing a spouse or de facto partner onto the title of a property you already own.
Separation & divorce
Transferring one partner's share to the other as part of a property settlement or court order.
Changing ownership shares
Adjusting the percentage each partner holds, for example from tenants in common to joint tenants.
You may pay little or no stamp duty
Many transfers between spouses and de facto partners qualify for a stamp duty exemption or concession, particularly for a principal place of residence or where the transfer is made under a family law agreement or court order. We check your eligibility as part of your matter and prepare the duty paperwork for you.
Exemptions depend on your state and circumstances. Weโll confirm what applies before you commit to anything.

Questions
Spousal transfer FAQs
Do we both need our own lawyer?+
For a straightforward transfer where both partners agree, we can usually act for the transaction. Where there is a dispute or a formal separation, each party may need independent advice. We'll tell you upfront which applies to your situation.
Will we have to pay stamp duty?+
Often not. Transfers between spouses or de facto partners frequently qualify for an exemption or concession, especially for the family home or under a family law agreement. We assess your eligibility and handle the duty paperwork as part of your matter.
What does the $1,100 cover, and what's extra?+
The $1,100 is our fixed professional fee for handling the transfer end to end. Third-party charges are separate: PEXA fees, land registry fees, any bank fees, and stamp duty if it applies. Your quote sets these out clearly.
When do we actually pay?+
Not upfront. You pay our professional fee at settlement, once the transfer is complete. Third-party charges are payable as they fall due during the matter.
Which states do you cover?+
NSW, ACT, VIC, QLD, SA and WA. The same fixed price applies wherever the property is located.
